Unless otherwise specified, any person who violates this chapter is guilty of a gross misdemeanor and upon conviction may be imprisoned for up to three hundred sixty-four (364) days, or fined not more than five thousand dollars ($5,000.00), or both. The prosecutor is encouraged to divert such cases for assessment, treatment or other services.
