A. Any rental agreement or renewal of a rental agreement related to a mobile home lot in the city of Aberdeen entered into after the effective date of this chapter shall include or shall be deemed to include a provision requiring a minimum of one hundred twenty days (120) prior written notice whenever the periodic or monthly housing costs charged to a tenant increase by three (3) percent or more over the periodic or monthly rental rate charged the same tenant for the same unit and same services for any period or month during the preceding twelve (12) month period.

B. This section does not apply the use of Section 8 housing, rentals provided by the housing authority, or other subsidy provider.

C. The city does not provide direct services to tenants, such as legal advice or other assistance. Tenants who believe the notice provisions of this municipal code have been violated should consult with an attorney of their choice about how to best protect their rights.

D. Late Fees. Late fees or costs due to nonpayment of rent charged to a tenant shall not exceed one and one-half (1.5) percent of the tenant’s monthly rent.
