The provisions of this chapter shall not apply to:

A. Any person paying an admission charge to any activity of an elementary or secondary school;

B. Any person paying ten cents ($0.10) or less as an admission charge;

C. Any person who is admitted free and from whom no compensating payment is obtained for such free admission;

D. Any person paying an admission charge to any public performance or event promoted or produced by any nonprofit organization;

E. Any person paying an admission charge to any public performance or event primarily featuring live musical or theatrical performances in the Downtown Parking and Business Improvement District. For the purposes of this exemption "primarily" shall mean the use of recorded music or visual displays are incidental to or part of the live performance.

Prior to the adoption of 6504 on 09/08/2010, Section 3.72.040 read as follows.

The provisions of this chapter shall not apply to:
