The filing of an appeal stays all actions by the department from seeking enforcement or compliance against the decision being appealed; provided, however, that the department may require that the activity or use cease or be removed if its continuance would result in an imminent threat to life or property. In such an event, the stay will remain in place until a decision is reached by the hearing examiner.

Prior to the adoption of 6475 on 02/25/2009, Section 17.76.050 read as follows.

The filing of an appeal stays all actions by the department from seeking enforcement or compliance against the decision being appealed; provided, however, that the department may require that the activity or use cease or be removed if its continuance would result in an imminent threat to life or property. In such an event, the stay will remain in place until a decision is reached by the board of adjustment. (Prior code § 11.024.050)
