15.10.370 Heating facilities.
A. Facilities Required. Heating facilities shall be provided in structures as required by this section.
B. Residential Occupancies. Dwellings shall be provided with heating facilities capable of maintaining a room temperature of sixty-eight (68) degrees F (twenty (20) degrees C) in all habitable rooms, bathrooms and toilet rooms based on the winter outdoor design temperature for the locality indicated in Appendix D of the International Plumbing Code. Cooking appliances shall not be used, nor shall portable unvented fuel-burning space heaters be used, as a means to provide required heating.
Exception: In areas where the average monthly temperature is above thirty (30) degrees F (minus one (-1) degree C), a minimum temperature of sixty-five (65) degrees F (eighteen (18) degrees C) shall be maintained.
C. Heat Supply. Every owner and operator of any building who rents, leases or lets one (1) or more dwelling units or sleeping units on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat to maintain a minimum temperature of sixty-eight (68) degrees F (twenty (20) degrees C) in all habitable rooms, bathrooms and toilet rooms.
Exceptions:
1. When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required; provided, that the heating system is operating at its full design capacity. The winter outdoor design temperature for the locality shall be as indicated in Appendix D of the International Plumbing Code.
2. In areas where the average monthly temperature is above thirty (30) degrees F (minus one (-1) degree C), a minimum temperature of sixty-five (65) degrees F (eighteen (18) degrees C) shall be maintained.
D. Occupiable Work Spaces. Indoor occupiable work spaces shall be supplied with heat to maintain a minimum temperature of sixty-five (65) degrees F (eighteen (18) degrees C) during the period the spaces are occupied.
Exceptions:
1. Processing, storage and operation areas that require cooling or special temperature conditions.
2. Areas in which persons are primarily engaged in vigorous physical activities.
E. Room Temperature Measurement. The required room temperatures shall be measured three (3) feet (nine hundred fourteen (914) mm) above the floor near the center of the room and two (2) feet (six hundred ten (610) mm) inward from the center of each exterior wall.
