6.04.210 Violations—Penalties in general.
A. Except where otherwise provided in this chapter, the failure to perform any act required by this chapter, the performance of any act prohibited or declared unlawful by this chapter, or any violations of the terms of this chapter is designated as an infraction and shall not be classified as a criminal offense. Any person found to have committed an infraction under this chapter shall be assessed a monetary penalty as follows:
1. For the first offense in one year not less than twenty-five dollars ($25.00) nor more than one hundred fifty dollars ($150.00).
2. For a second offense within one year, not less than fifty dollars ($50.00) nor more than three hundred dollars ($300.00).
B. A person found to have committed a third or subsequent offense as provided in this chapter, of any kind, including offenses which would otherwise be designated as an infraction, within one year, shall be guilty of a misdemeanor, punishable by confinement in jail not to exceed ninety (90) days and by fine not to exceed five hundred dollars ($500.00).
