Where a subdivider owns not less than one-eighth of a section or, if the land is not capable of subdivisional description, eighty (80) acres, he may define the boundaries of his short subdivision to include not less than one-sixteenth of a section or, if the land is not capable of subdivisional description, forty (40) acres, remain; and provided further, that his definition of boundary leaves proper provision for access to the remaining parcel and is approved by the approving authority.
