A. Pursuant to the authority of RCW 35.21.180 authorizing the adoption by cities and towns of fire codes, by reference, there is adopted by reference that certain code known as Fire Prevention Code recommended by the American Insurance Association, successor to the National Board of Firewriters, 1970 Edition, including Appendix “A” and Appendix “B” except such portions as are deleted, modified or amended, of which code and revision three (3) copies have been and now are filed in the office of the city comptroller of the city of Aberdeen and the same are adopted and incorporated as fully as if set out at length herein and from the date on which the ordinance codified herein takes effect, and the provisions thereof shall be controlling within the city limits of the city of Aberdeen.

B. The State Fireworks Law, Chapter 70.77 RCW, as presently existing or subsequently amended, is hereby adopted, incorporated and made part of this chapter by reference. A copy of Chapter 70.77 RCW, including all future amendments, shall be maintained for use and examination by the public in the office of community development.

C. The rules of the State Director of Fire Protection relating to fireworks, Chapter 212-17 WAC, as presently existing or subsequently amended, are hereby adopted, incorporated and made part of this chapter by reference. A copy of Chapter 212-17 WAC, including all future amendments adopted pursuant to the Washington Administrative Procedure Act, Chapter 34.04 RCW, shall be maintained for use and examination by the public in the office of community development.

D. In any instance where the express terms of this chapter conflict with the provisions of the state codes adopted by reference, the terms of this chapter shall govern, it being the intent of this section that local fireworks regulation by the city shall follow the provisions and procedures for state licenses as closely as practical while recognizing the exercise of local options regarding the sale and discharge of fireworks.
