A. Payment. All charges for solid waste and recyclable collection shall be collected by any private contractor (“contractor” or “vendor”) who provides collection services in accordance with the terms of this chapter.

B. Delinquency. In the event a customer does not pay the private contractor by the due date, the customer will be given reasonable opportunity to bring the account current. If the customer does not bring the account current within thirty (30) days, and with prior written notice to the customer, the private contractor may suspend solid waste and recyclable service to the customer. If the customer remains delinquent for sixty (60) days or greater, the private contractor may remove the solid waste and recycle containers. If the customer remains delinquent in excess of ninety (90) days, the private contractor may pursue additional legal remedies including seeking private debt collection services. In any case when a customer has cured delinquency, the private contractor shall resume solid waste and recyclable service.

If service is suspended, the city may determine the premises where suspension occurs to be unsanitary or otherwise noncompliant with building or public nuisance laws. In such case, a lien may be made by the city against the property. Such lien shall become effective upon the filing by the city of a notice of lien in the office of the Grays Harbor County Auditor, which notice shall specify the amount of the charges, the period covered by the charges, and a legal description of the premises. Such lien shall be foreclosed in the same manner as are liens for labor and materials for the improvement of real property.

C. Rates for Curbside Service. Rates for collection services are specified in the contract between the city and the vendor, including any amendments or addenda. The most recent rate schedule is maintained in the public works office and is available upon request, or on the city’s website. The rate schedule includes, but is not limited to, the following:

1. Residential and commercial cart services;

2. Permanent and temporary container services;

3. Compactor and drop box services;

4. Special service charges;

5. Roll-outs due to special circumstances or customer hardship;

6. Special item removal;

7. Lock and cable fee.

The tipping fee to be added to the charges for drop boxes is at the rates established by contract with Grays Harbor County and other regulatory agencies for disposal sites meeting minimum functional standards set by the Washington State Department of Ecology.

No load is to exceed nine (9) tons.

D. Monthly Billing. No refund of charges paid shall be made for other than a full calendar month for which service is not required. In the event the city shall combine the billing for solid waste and recyclable collection with the billing for city water and sewer services, the city shall have the right to apply any partial payments on utility bills first to the payment of charges for solid waste and recyclable collection with the balance to be applied toward the payment of remaining current utility charges, in such order as the finance director shall see fit, but lastly to charges for water service.

Prior to the adoption of 6585 on 11/23/2015, Section 13.08.110 read as follows.

A. Payment. The finance director shall collect all charges for solid waste and recyclable collection as agent for any private contractor who provides collection services in accordance with the terms of this chapter, and such charges shall be payable concurrent with water and/or sewer charges for the premises served, except that charges for quantity waste disposal and extra service shall be collected monthly by the contractor.

B. Delinquency. Any charges not paid within twenty-one (21) days of billing date shall be delinquent, and, upon delinquency, shall become a lien upon the real property to which the collection services have been rendered. Such lien shall become effective upon the filing by the city of a notice of lien in the office of the Grays Harbor County Auditor, which notice shall specify the amount of the charges, the period covered by the charges, and a legal description of the premises. Such lien shall be foreclosed in the same manner as are liens for labor and materials for the improvement of real property.

C. The monthly standard curb rate (container must be placed at the curb on the scheduled service day) for properly used and maintained approved solid waste and recycle containers, with recycle containers serviced every two weeks, shall be as follows:

D. Special service charges. The following special service charges are in addition to the monthly curb service rates. Charges for special services may be billed by and paid directly to the contractor and, if unpaid, shall be added to the utility bill under 13.08.110(A).

1. Physical hardship-roll out. The Director may authorize special collection services and rates, in addition to those set forth in this chapter, when special circumstances relating to the size, shape, topography, location or surroundings of the property being served or physical disabilities of the utility customer create an unnecessary hardship; PROVIDED that the additional costs charged do not exceed the actual cost of providing the special collection services. If the special collection services require the collector to roll the cart out to the curb, for each increment of fifty (50) feet the monthly curbside service rate shall be increased by $1.23 for carts serviced monthly, $2.47 for carts serviced every other weeks and $4.94 for carts serviced weekly.

2. Special Item Removal. For each of the following types of items picked up on a one time basis the charge will be:

a. Small appliances, furniture, bulky items, etc.: $26.50 each

b. Large applicances, refrigerators, freezers, etc.: $61.60 each

3. Prepaid plastic thirty (30) gallon bags furnished by the city, $4.37 each.

4. Special collection calls. Collection calls requested by a customer for a regular packer truck requiring loading of loose material, including travel time, an hourly rate of $64.34 plus disposal fees .

5. Loose material collection. Collection of container overflows or solid waster or recyclable materials not properly placed in approved containers, and collections ordered pursuant to 13.08.130(B), will be charged at an hourly rate, including travel time, or $64.34, plus disposal fee.

E. Container Services. Rates for quanity garbage, commercial collection, customer owned compactors, or permanent and temporary drop box services shall be as follows, not including refuse collection tax:

3. One (1) 65 gallon toter serviced every two weeks: $15.44;

4 One (1) 65 gallon toter serviced weekly: $25.45;

5. Additional service for a 65-gallon tote: $6.66;

6. One (1) 95 gallon toter serviced monthly: $10.93;

7. One (1) 95 gallon toter serviced every two weeks: $22.46;

8. One (1) 95 gallon toter serviced weekly: $35.45;

9. Additional service for 95-gallon tote: $9.99.

D. Special service charges. The following special service charges are in addition to the monthly curb service rates. Charges for special services by be billed by and paid directly to the contractor and, if unpaid, shall be added to the utility bill under 13.08.110(A).

4. Special collection calls. Collection calls requested by a customer for a regular packer truck requiring loading of loose material, including travel time, an hourly rate of $55.00 plus disposal fees .

5. Loose material collection. For each collection of container overflows or solid waste materials accumulated on the customers premises and not properly placed in approived containers, and for collections ordered pursuant to 13.08.130(B), an hourly rate of $55.00 including travel time, plus disposal fee.

Prior to the adoption of 6337 on 01/22/2003, Section 13.08.110 read as follows.

A. Payment. The finance director shall collect all charges for solid waste and recyclable collection as agent for any private contractor who provides collection services in accordance with the terms of this chapter, and such charges shall be payable concurrent with water and/or sewer charges for the premises served, except that charges for quantity waste disposal and extra service shall be collected monthly by the contractor.

B. Delinquency. Any charges not paid within twenty-one (21) days of billing date shall be delinquent, and, upon delinquency, shall become a lien upon the real property to which the collection services have been rendered. Such lien shall become effective upon the filing by the city of a notice of lien in the office of the Grays Harbor County Auditor, which notice shall specify the amount of the charges, the period covered by the charges, and a legal description of the premises. Such lien shall be foreclosed in the same manner as are liens for labor and materials for the improvement of real property.

C. The monthly standard curb rate (container must be placed at the curb on the scheduled service day) for properly used and maintained approved solid waste containers with recycle bins serviced every two weeks at curb (next to road or alley as used where a truck can drive while proceeding in normal route) shall be as follows:

1. One (1) 65 gallon toter with a 30 gallon insert serviced once per month: $6.25;

2. One (1) 65 gallon toter serviced monthly: $9.60;

3. One (1) 65 gallon toter serviced every two weeks: $15.30;

4 One (1) 65 gallon toter serviced weekly: $25.17;

5. Additional service for a 65-gallon tote: $6.60;

6. One (1) 95 gallon toter serviced monthly: $10.83;

7. One (1) 95 gallon toter serviced every two weeks: $22.25;

8. One (1) 95 gallon toter serviced weekly: $35.04;

9. Additional service for 95-gallon tote: $9.89.

D. Special service charges. The following special service charges are in addition to the monthly curb service rates. Charges for special services by be billed by and paid directly to the contractor and, if unpaid, shall be added to the utility bill under 13.08.110(A).

1. Physical hardship. The Director may authorize special collection services and rates, in additon to those set forth in this chapter, when special circumstances relating to the size, shape, topography, location or surroundings of the property being served or physical disabilities of the utility customer create an unnecessary hardship; PROVIDED that the additional costs charged do not exceed the actual costs of providing the special collection services. If the special collection services require the collector to roll the toter out to the curb, for each increment of fifty (50) feet the monthly curbside service rate shall be increased by $1.15 for toters serviced monthly, $2.30 for toters serviced every two weeks, and $4.60 for toters serviced weekly.

2. Special Item Removal. For each of the following type items picked up on a one-time basis the charge will be twenty-two dollars twenty-four cents ($22.24) each:

a. Appliances, stoves, refrigerators, etc.;

Prior to the adoption of 6252 on 06/28/2000, Section 13.08.110 read as follows.

A. Payment. The finance director shall collect all charges for solid waste and recyclable collection as agent for any private contractor who provides collection services in accordance with the terms of this chapter, and such charges shall be payable concurrent with water and/or sewer charges for the premises served, except that charges for quantity waste disposal and extra service shall be collected monthly by the contractor.

B. Delinquency. Any charges not paid within fifty (50) days of billing date shall be delinquent, and, upon delinquency, shall become a lien upon the real property to which the collection services have been rendered. Such lien shall become effective upon the filing by the city of a notice of lien in the office of the Grays Harbor County Auditor, which notice shall specify the amount of the charges, the period covered by the charges, and a legal description of the premises. Such lien shall be foreclosed in the same manner as are liens for labor and materials for the improvement of real property.

C. Rates. Charges for solid waste and recyclable collection, removal and disposal shall be as follows:

1. Monthly standard curb rate for can(s) serviced weekly and recycle bins serviced every two weeks at curb (next to road or alley as used where a truck can drive while proceeding in normal route):

a. 1 mini-can: ten dollars twenty-five cents ($10.25)

b. 1 standard container: fourteen dollars forty-seven cents ($14.47)

c. Each additional standard container an additional charge of nine dollars twenty-nine cents ($9.29)

2. Monthly minimum service curb rate for one standard container or mini-can serviced once per month with every other week curbside recycling, five dollars ninety-three cents ($5.93) (can must be placed at the curb on the scheduled service day).

3. Carry Service. For each increment of fifty (50) feet or any fraction thereof (unobstructed), add one dollar eighty-two cents ($1.82)/each can/month (recycle bins must be placed at curb for collection).

4. Obstacles for each of the following, add one dollar forty-two cents ($1.42)/each can/month:

a. Flight of 10 stairs;

b. Gate or door;

c. Overhead obstruction preventing carryout container from being shouldered.

5. Special Item Removal. For each of the following type item picked up on a one-time basis the charge will be twenty-one dollars twelve cents ($21.12) each:

a. Old burning barrels;

b. Appliances, stoves, refrigerators, etc.;

c. Drums.

6. Extra boxes, bags or cans not to exceed thirty (30) gallons, three dollars eleven cents ($3.11) each.

7. Special collection calls by a regular packer truck that requires loading of loose material and may include travel time, an hourly rate of sixty-six dollars seventeen cents ($66.17).

D. Special service charges. The following special service charges are in addition to the monthly curb service rates. Charges for special services may be billed by and paid directly to the contractor and, if unpaid, shall be added to the utility bill under 13.08.110(A).

1. Physical hardship-roll out. The Director may authorize special collection services and rates, in addition to those set forth in this chapter, when special circumstances relating to the size, shape, topography, location or surroundings of the property being served or physical disabilities of the utility customer create an unnecessary hardship; PROVIDED that the additional costs charged do not exceed the actual cost of providing the special collection services. If the special collection services require the collector to roll the cart out to the curb, for each increment of fifty (50) feet the monthly curbside service rate shall be increased by $1.22 for carts serviced monthly, $2.44 for carts serviced every other weeks and $4.89 for carts serviced weekly.

2. Special Item Removal. For each of the following types of items picked up on a one time basis the charge will be:

a. Small appliances, furniture, bulky items, etc.: $26.22 each

b. Large applicances, refrigerators, freezers, etc.: $60.94 each

3. Prepaid plastic thirty (30) gallon bags furnished by the city, $4.30 each.

In the event the city shall combine the billing for solid waste and recyclable collection with the billing for city water and sewer services, the city shall have the right to apply any partial payments on utility bills first to the payment of charges for solid waste and recyclable collection with the balance to be applied toward the payment of remaining current utility charges, in such order as the finance director shall see fit, but lastly to charges for water service.

Prior to the adoption of 6454 on 12/27/2007, Section 13.08.110 read as follows.

A. Payment. The finance director shall collect all charges for solid waste and recyclable collection as agent for any private contractor who provides collection services in accordance with the terms of this chapter, and such charges shall be payable concurrent with water and/or sewer charges for the premises served, except that charges for quantity waste disposal and extra service shall be collected monthly by the contractor.

B. Delinquency. Any charges not paid within twenty-one (21) days of billing date shall be delinquent, and, upon delinquency, shall become a lien upon the real property to which the collection services have been rendered. Such lien shall become effective upon the filing by the city of a notice of lien in the office of the Grays Harbor County Auditor, which notice shall specify the amount of the charges, the period covered by the charges, and a legal description of the premises. Such lien shall be foreclosed in the same manner as are liens for labor and materials for the improvement of real property.

C. The monthly standard curb rate (container must be placed at the curb on the scheduled service day) for properly used and maintained approved solid waste and recycle containers, with recycle containers serviced every two weeks, shall be as follows:

1. One (1) 65 gallon toter with a 30 gallon insert serviced once per month: $8.09;

2. One (1) 65 gallon toter serviced monthly: $11.69;

3. One (1) 65 gallon toter serviced every two weeks: $17.83;

4 One (1) 65 gallon toter serviced weekly: $28.55;

5. Additional service for a 65-gallon tote: $7.35;

6. One (1) 95 gallon toter serviced monthly: $13.06;

7. One (1) 95 gallon toter serviced every two weeks: $25.31;

8. One (1) 95 gallon toter serviced weekly: $39.22;

9. Additional service for 95-gallon tote: $10.93.

D. Special service charges. The following special service charges are in addition to the monthly curb service rates. Charges for special services may be billed by and paid directly to the contractor and, if unpaid, shall be added to the utility bill under 13.08.110(A).

1. Physical hardship-roll out. The Director may authorize special collection services and rates, in addition to those set forth in this chapter, when special circumstances relating to the size, shape, topography, location or surroundings of the property being served or physical disabilities of the utility customer create an unnecessary hardship; PROVIDED that the additional costs charged do not exceed the actual cost of providing the special collection services. If the special collection services require the collector to roll the toter out to the curb, for each increment of fifty (50) feet the monthly curbside service rate shall be increased by $1.15 for toters serviced monthly, $2.30 for toters serviced every two weeks, and $4.60 for toters serviced weekly.

2. Special Item Removal. For each of the following types of items picked up on a one time basis the charge will be:

a. Appliances, stoves, bulky items, etc.; $23.83 each

b. Refrigerators, freezers $55.65 each

3. Prepaid plastic thirty (30) gallon bags furnished by the city, $3.77 each.

4. Special collection calls. Collection calls requested by a customer for a regular packer truck requiring loading of loose material, including travel time, an hourly rate of $58.33 plus disposal fees .

5. Loose material collection. Collection of container overflows or solid wast or recyclable materials not properly placed in approved containers, and collections ordered pursuant to 13.08.130(B), will be charged at an hourly rate, including travel time of $57.19 plus disposal fee.
